Terms of Use MyAI University Platform v 0.3
The below Terms of Use are work in progress and are subject to change.
I. General
- These Terms and Conditions define the rules for using the MyAI University educational platform, available at platform.myaiuniversity.eu
- The operator of the MyAI University Platform is Kozminski University with its registered office in Warsaw, address: Jagiellońska 57, 03-301 Warsaw, entered into the register of non-public universities kept by the minister competent for higher education at No. 17, NIP 5241005438, REGON 010228830.
- The Operator may be contacted in matters concerning the Platform by correspondence at 57 Jagiellońska Street, 03-301 Warsaw; by e-mail at kontakt@kozminski.edu.pl or by phone at +48 22 519 21 00
- MyAI University The platform was created as part of the EUonAIR – European University on AI in Curricula, Smart UniverCity and (Return) Mobility project implemented by a consortium of EUonAIR partner universities.
- The MyAI University platform is co-financed by the European Union as part of the EUonAIR project (contract no. 101177370) and the Ministry of Science and Higher Education (contract no. MNiSW/2025/DWM/420).
- The content published on the MyAI University Platform reflects the views of the authors only and may differ from the position of the European Union, the European Education and Culture Executive Agency (EECEA), the Operator, the Consortium or its members.
- MyAI University Platform is governed by Polish law.
- The Terms and Conditions are regulations within the meaning of Article 8 of the Act of 18 July 2002 on the provision of services by electronic means (i.e. Journal of Laws of 2024, item 1513) and are made available free of charge at the address platform.myaiuniversity.eu, from where they can be obtained, recorded, reproduced or printed.
- Before starting to use the services provided electronically and registering, the User is obliged to read the Terms and Conditions. Using the services made available on the MyAI University Platform means accepting the provisions of the Terms and Conditions.
II. Definitions
The terms used in the Terms and Conditions mean:
- AI Act – Regulation (EU) 2024/1689 of the European Parliament and of the Council of 13 June 2024 laying down harmonised rules on artificial intelligence (Artificial Intelligence Act).
- Avatar – a digital representation of the User in the MyAI University Metaverse, selected from a collection of virtual characters, with the help of which the User moves around the virtual campus and uses its functionalities.
- Personal data – any information relating to an identified or identifiable, directly or indirectly, natural person, within the meaning of Article 4(1) of the GDPR.
- User Account – an individualized set of the User’s permissions and resources created as a result of registration, through which the User uses the MyAI University Platform, including the Courses, and manages their data
- Courses – an accredited course or educational module offered by a Partner University through the MyAI University Platform.
- Micro-credential – a digital confirmation of the learning outcomes achieved by the User as a result of completing the Course, issued by the partner University, in accordance with the Recommendation of the Council of the European Union of 16 June 2022 on a European approach to micro-credentials for lifelong learning and employability (2022/C 243/02).
- MyAI University – an educational environment, implemented by the Operator in cooperation with partner universities within the EUonAIR project, using AI tools and enabling access to the Courses of partner universities, which includes the MyAI University Platform and the MyAI University Metaverse; the name MyAI University is also a distinguishing mark (brand).
- MyAI University Metaverse – a virtual Metaverse campus available through an application installed on the User’s device, constituting an immersive digital environment in which the User acts using their own Avatar.
- MyAI University Platform – MyAI University’s educational platform available via a web browser at platform.myaiuniversity.eu, using AI tools and enabling access to Courses of partner universities.
- Operator – Kozminski University with its registered office in Warsaw, address: 57 Jagiellońska Street, 03-301 Warsaw, entered into the register of non-public universities kept by the minister competent for higher education at No. 17, NIP 5241005438, REGON 010228830, which can be quickly contacted by phone or online at the following address:
- GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation).
- Terms and Conditions – these Terms and Conditions meeting the requirements of the Terms and Conditions for the Provision of Services by Electronic Means within the meaning of Article 8 of the Act of 18 July 2002 on the Provision of Services by Electronic Means (i.e. Journal of Laws of 2024, item 1513), specifying, in particular, the rules for the provision of free services provided by electronic means by Kozminski University, the rules for using the Platform or applications available through it, and the procedure for reporting violations.
- Registration – the activity of filling in the registration form in the MyAI University Platform and accepting the Terms and Conditions, as a result of which an Account is created.
- Website – a page accessible at myaiuniversity.eu from which the User can go to the MyAI University Platform, MyAI University Metaverse or External Tools; the page includes tabs, e.g. Program, Tools, Community, About MyAI University.
- AI system – components of artificial intelligence and machine learning used within MyAI University, in particular mechanisms for recommending Courses and analysing the User’s learning progress.
- Partner University – a university that is part of a consortium implementing the EUonAIR project; the current list of Partner Universities is available on the Website.
- External Services – services integrated with MyAI University or accessible from the Website, in particular Google Workspace, Discord, My Mobility Assessment, provided on the basis of separate rules and regulations and not forming part of MyAI University.
- User – a natural person, student or employee (scientific, didactic or administrative) of a Partner University, who has an active account in the domain of the Partner University entitling them to access the MyAI University Platform, who has registered a User Account.
III. MyAI University Terms of Use
1. Technical Requirements Necessary to Use MyAI University
- The use of electronic services and electronic forms of communication made available at MyAI University requires the User to use technical measures to minimize the risks resulting from the public nature of the Internet network used by the User. The device used by the User should have, in particular:
- Antivirus system with up-to-date virus definitions and updates
- an active and effective firewall,
- installed up-to-date security patches (updates) of the operating system and web browser,
- legitimate and up-to-date software, including software that secures your e-mail and protects your identity on the web.
- In order to use MyAI University, the User should have:
- access to a computer or other communication device connected to the Internet with a connection that allows smooth playback of video content (e.g. for the purpose of using the Courses),
- an active e-mail address in the domain of the Partner University (e.g. for the purpose of Account Registration and use of the content made available on the platform or access to the User’s resources),
- an updated web browser – it is recommended to use the browser in the latest available version of Microsoft Edge, Google Chrome, Mozilla Firefox, Safari or Opera (e.g. to use MyAI University Platform, MyAI University Metaverse)
- enabled support for Cookies and Javascript in the web browser,
- The software that allows you to read the files in PDF format.
- In order to use MyAI University unhindered, it is recommended that the User has access to the Internet with a stable connection.
2. General rules for the availability and use of MyAI University
- The MyAI University environment has been designed with digital accessibility requirements (e.g. the WCAG standard) in mind, including the ability to adjust contrast and text size, ………
- The use of MyAI University requires the use of legal software and technical measures by the User to minimize the risks resulting from the public nature of the Internet.
- When using MyAI University, it is prohibited for the User to enter or transmit content of an illegal nature, contrary to the principles of social coexistence or violating the personal rights of others.
- The Operator makes every effort to ensure that MyAI University operates properly and uninterruptedly, however, due to its developmental nature, the Operator does not guarantee uninterrupted access. Technical and service breaks are possible. The Operator may temporarily interrupt or limit access to MyAI University in the event of modernization, maintenance work, changes in functionality, for the time necessary to carry them out.
- The Operator has the right to block or temporarily limit access to MyAI University for security reasons in the event of failures or technical breaks and in the event of other threats, including those resulting from external reasons, for the time necessary to remove the irregularities.
- The Operator may moderate the content published in MyAI University, including removing content that violates the Terms and Conditions and temporarily or permanently restricting access to Users who violate the Terms and Conditions.
- The use of MyAI University involves the processing of the User’s personal data and data on the User’s activity. The principles of data processing are set out in the Privacy Policy.
3. Obligations of the User
- The User is obliged to use MyAI University in accordance with the law, the Terms and Conditions, good manners and the purpose of individual functionalities. When using External Services, the User is obliged to comply with separate terms and conditions for the use of these services.
- A User using MyAI University is obliged to comply with the rules of social coexistence and respect the rights of other Users. In particular, the following are prohibited: harassment, intimidation, harassment and other forms of violation of personal dignity; dissemination of illegal content or content constituting hate speech or discriminatory on the basis of gender, race, ethnic or national origin, religion, belief, worldview, disability, age or sexual orientation; impersonating another person, including another User, or using a misleading Avatar as to identity; disrupting the course of Courses or events organized at MyAI University; disseminating content containing malware.
- The User must not take actions that threaten the proper functioning or security of MyAI University, in particular: attempts to circumvent, disable or breach the security of MyAI University; attempts to access the Accounts of other Users; share their own login details with third parties; use automatic tools for downloading, indexing or exploring content.
- It is prohibited to illegally copy and distribute the content available at MyAI University, including the content of the Courses. The content made available at MyAI University is subject to copyright protection. The rules for their permissible use are specified in point VII of the Terms and Conditions.
- It is prohibited to process video and audio materials from the Courses using artificial intelligence tools in any way, in particular to modify them, generate new materials based on them, as well as to use the image, voice or manner of expression of the persons appearing in them to train artificial intelligence models or to produce new content. The prohibition also includes making these materials available to third parties or artificial intelligence systems for such processing.
- You may not interfere with the operation of AI Systems, including intentionally providing false data to manipulate recommendations or results, or attempting to circumvent their mechanisms.
- You may use MyAI University for educational purposes only. You may not use MyAI University and the content provided therein for commercial purposes.
4. Consequences of violations of the MyAI University rules by the User
- The Operator may suspend the provision of services within MyAI University to the User in the event of:
- suspected breach of security of Personal Data or the User Account – until the threat ceases or removes;
- breach of the Terms and Conditions by the User – until the breach ceases to exist.
- The Operator is entitled to terminate the provision of services within MyAI University to the User in the event of:
- breach the security of MyAI University or the security of using MyAI University or individual services by other Users – immediately,
- posting on the Website content of an unlawful, offensive, misleading nature, containing viruses or potentially causing disruption or damage to ICT systems – immediately,
- the User’s disruption of the operation of MyAI University or individual services or any other material breach of the Terms and Conditions by the User – after the User is called upon to cease/remove the violation and the deadline set for its cessation/removal has expired ineffectively
- The Operator informs the User who is affected by the decision to suspend or terminate the provision of services about the content of the decision made, its factual and legal basis and the possibility of lodging an appeal.
- The User may lodge an appeal with the Operator against the decision referred to in points 1) to 2) within 14 days of its receipt. The Operator shall consider the appeal within 14 days. The decision made as a result of considering the appeal is final within the proceedings conducted by the Operator.
5. Operator’s liability
- The Operator shall be liable for non-performance or improper performance of services provided under the Terms and Conditions on general terms, taking into account the restrictions resulting from the Terms and Conditions and the provisions of law.
- The Operator makes every effort to ensure that MyAI University is available on an ongoing basis. The Operator reserves the right to provide technical interruptions necessary for maintenance, updating or ensuring security. The Operator informs Users in advance of planned interruptions via the Website, unless the necessity of the interruption results from urgent circumstances.
- The Operator is not responsible for the provision of External Services by their operators or for the content published therein. The use of External Services takes place under the conditions specified by their operators in separate terms and conditions.
- The Operator shall not be liable for the User’s lack of access to MyAI University or irregularities in the operation of MyAI University resulting from reasons beyond its control, in particular: failures or disruptions in the operation of ICT, telecommunications or power supply systems located outside the Operator’s infrastructure; services of external operators providing data transmission; loss by the User of the status entitling to use MyAI University or deactivation of his/her university account by the Partner University.
- The Operator is not responsible for the consequences of failure of the User’s device or software to meet the technical requirements specified in the Terms and Conditions.
- The materials made available in MyAI University are of an educational nature only and do not constitute advice or recommendations of a substantive or professional nature. The Operator is not responsible for the consequences of using the Courses in a manner contrary to their educational purpose, including the effects of decisions made by the User on their basis. The compliance of the Courses with the current state of knowledge and standards of a given field is the responsibility of the Partner University providing the Course or the authors of the Courses.
- The results generated by the AI System, in particular Course recommendations and progress information, are of an auxiliary and indicative nature, they do not constitute an assessment of learning outcomes or a decision on access to Courses or Micro-credentials. The Operator is not responsible for the consequences of using these results in a manner contrary to their intended purpose, in particular treating them as binding assessments.
- Subject to the restrictions resulting from mandatory regulations, the Operator shall not be liable for damages resulting from causes beyond its control, including those caused by force majeure, arising in connection with the use or inability to use the Platform, in particular resulting from improper or defective functioning, deficiencies, disruptions, defects, delays in the course of operations or data transmission, computer viruses, failures of lines or IT systems, interruptions in the provision of Electronic Services.
- The Operator shall not be liable for the consequences of force majeure, which shall be understood as an external event, impossible to foresee and which could not have been prevented.
6. Services available in the MyAI University environment
- The Operator provides access to the Website, through which it is possible to access MyAI University. The Website’s Terms and Conditions, Privacy Policy, and Personal Data Protection Information are available in electronic form. These documents may be downloaded, saved, played or printed by the User free of charge.
- As part of MyAI University, Operator provides:
- MyAI University Platform, which includes Courses of partner universities,
- virtual immersive of the MyAI University Metaverse campus, the use of which requires downloading the application shared at the link
- Discord social support feature
- support in the field of Course recommendations based on the AI System and personalized tracking of learning progress, (????)
- With MyAI University, you can access External Services, in particular:
- MyMobility Assessment,
- ReTURN Mobility: The EUonAIR Handbook for Holistic Support,
- Gemini AI, Google Workplace, Notebook LM.
7. Termination of the provision of services by the Operator
In the event of the intention to terminate the provision of services (or selected services) within the MyAI University Programme, the Operator may terminate the agreement for the provision of services by electronic means to the User with a 30-day notice period.
IV. Using the MyAI University Platform
1. Nature of the service
- MyAI University The platform is educational and non-commercial.
- The use of the Website does not require Registration. The content made available on the MyAI University Platform may be used only by logged in Users.
- The use of the MyAI University Platform by Users is free of charge. The Operator does not charge Users for the use of any resources of the MyAI University Platform, including Courses.
- As part of MyAI University, the Operator Platform enables the User to:
- creating an Account, managing it and managing the User’s data;
- enrol in and participate in the Courses, including the use of text, video, audio and graphic materials made available within the Courses;
- tracking learning progress;
- obtaining a Micro-Attestation confirming the learning outcomes, on the terms specified by the partner University providing the given Course;
- recommending Courses using the AI System;
- access to MyAI University Discord.
- MyAI University The platform is in the development phase – the scope of the platform’s functionality is subject to change.
2. Access and login to the MyAI University Platform
- The resources of the MyAI University Platform can be used by Users who are students or employees of partner universities.
- Loss of your active affiliation with a Partner University (e.g. after graduation or employment) may result in the termination of your access to MyAI University, in accordance with the rules of the Partner University.
- Access to the resources of the MyAI University Platform, including the Courses, is possible after registering a User Account and logging in to it. Without logging in, only the information provided on the Website is available
- Registration of the User Account requires the provision of the User’s personal data, including: name, surname, e-mail in the domain of the partner University.
- Logging in to the User Account is possible only using the User’s e-mail address in the domain of the Partner University provided during Registration and the password set by the User.
- The User is entitled to use only their own User Account.
- The User may not share login details with third parties. In the event of suspicion of access to the Account by an unauthorized person, the User shall immediately inform the Operator thereof.
3. Termination of MyAI University Platform
- The User of the Website may at any time and without giving reasons terminate the use of electronic services available through the Website. Termination of use means the implicit termination of the agreement for the provision of a free electronic service in the form of the Website.
- The User of the MyAI University Platform may discontinue the use of the service at any time and without giving reasons. The User may log out of the Account or delete the User Account. In order to delete the Account, the User should contact the Operator at ……………………….. Deleting User’s account will remove User’s access to User’s data on MyAI University Platform. This action is irreversible.
- In the event of loss of the User’s active affiliation with the Partner University, the Operator informs the User of the intention to block or delete the Account due to the expiration of access to the e-mail address provided during the Account Registration, at least 30 days in advance, allowing the User to download the obtained Micro-credentials and information about completed Courses.
- Deletion of the User’s Account does/does not cause? deletion of accounts/data? of the User in the External Services, in particular in Google Workspace, Gemini, NotebookLM and My Mobility Assessment. The rules and consequences of terminating the use of the External Services made available within the MyAI University Platform are determined by separate terms and conditions for the use of these service tools, which the User accepts when starting to use them.
V. MyAI University Metaverse
1. Nature of the service
- MyAI University Metaverse offers the User an immersive educational environment of an interactive nature using gaming solutions, in which the User can, for example, move the Avatar around the virtual campus, interact with objects and other Avatars, perform educational tasks and missions, play the content of the Courses, participate in events virtually.
- The use of MyAI University Metaverse involves the processing of data on the User’s activity in the virtual environment, including data on the Avatar’s movements, interactions with objects, tasks performed, time of use and the content of communication with other Users. The scope, purposes, legal bases and storage periods of this data, as well as the rules for the processing of personal data by the AI System, are specified in the Privacy Policy.
- The Operator declares that as of the date of entry into force of the Terms and Conditions, no AI Systems are used as part of the MyAI University Metaverse.

The Operator declares that as of the date of entry into force of the MyAI University Terms and Conditions, the Metaverse uses AI Systems in order to: The functions of the AI Systems used by MyAI University are supportive and advisory in nature. They do not replace academic decisions made by partner universities or the User’s self-assessment. The results of the AI System (recommendations, analyses, suggestions) may be inaccurate or incomplete and should be treated only as suggestions to support learning. - The above-mentioned rules regarding the use of AI Systems do not apply to the use of AI tools in External Services, including Gemini, NotebookLM and My Mobility Assessment. The use of AI Systems is carried out on the terms specified by their Operators in separate Terms and Conditions.
- MyAI University Metaverse is in development — the platform’s functionality is subject to change.
2. Accessing and Using MyAI University Metaverse
- MyAI University Metaverse, is made available in the form of an application installed on the User’s device. Upon downloading the application, the Operator grants the User a non-exclusive, non-transferable and free-of-charge license to use it solely for their own educational use, for the duration of the Account, without the right to grant sublicenses. It is prohibited to reproduce, decompile, modify and distribute the application beyond the scope permitted by mandatory regulations.
- The user performs actions in the MyAI University Metaverse using the Avatar.
- A User may report a violation of the rules by another User through the functionality available in the MyAI University Metaverse or in the mode specified in § … (Reporting violations).
3. End of MyAI University Metaverse
- The User of MyAI University Metaverse may discontinue the use of the service at any time and without giving reasons, in particular by uninstalling the application from the User’s device. Termination of use of MyAI University Metaverse does not result in the deletion of the Account or termination of the use of the MyAI University Platform.
- Uninstalling the application causes the expiration of the license referred to in point V.2.1. The User is obliged to delete all copies of the application in their possession.
- Losing access to the MyAI University Platform means losing the ability to use the MyAI University Metaverse.
- The rules and consequences of terminating the use of External Services made available as part of the MyAI University Metaverse are determined by separate terms and conditions for the use of these service tools, which the User accepts by starting to use them.
- The Operator may suspend or permanently block the User’s access to MyAI University Metaverse in the event of a breach of the obligations set out in the Terms and Conditions on the terms and conditions set out in point III.4 (Consequences of violations of the rules of using MyAI University by the User).
VI. Serwis Discord
1. Nature of the service
- Discord is an external service on Discord, dedicated to MyAI University Users, accessible from the MyAI University Platform and the MyAI University Metaverse.
- The Discord service is operated by Discord Netherlands BV. The use of MyAI University Discord is subject to the separate Terms and Conditions of the service operator.
- The operator is solely responsible for running the server on Discord, its structure and moderation of the content posted on it.
- The Discord service is used to communicate Users and their contact with the Operator and partner universities, including conducting text and voice conversations, thematic discussions and organizing meetings.
2. Accessing and Using MyAI University Metaverse
- The use of MyAI University Discord is voluntary and is not a prerequisite for the use of other elements of MyAI University or participation in the Courses.
- In connection with the use of the Discord service, data is processed, including, in particular, the User’s name, the content of the messages posted by the user and information about activity on the service. The operator and the provider of the Discord service process this data independently, to the extent appropriate to their roles, and the details of data processing are specified in the Privacy Policy of each entity.
3. End of Discord
- The user loses access to Discord along with the loss of access to MyAI University.
- Ceasing to use the Discord service does not automatically delete messages previously posted by the User on the Discord server. These messages remain visible to others The processing of the content posted by the User on the Discord service takes place on the terms specified by the Operator of this service in separate terms and conditions.
VII. Courses
- After logging in to MyAI University, the User gains access to the catalog of Courses provided by the Partner Universities and can enroll in the selected Course.
- The partner university providing the course determines its content, conditions of participation, rules of completion and the method of confirming the completion of the Course. The Operator is not responsible for the description, substantive content, compliance of the description with the substantive content of the Courses offered by other partner universities.
- From the description of the Course, the User can learn: …………
- After meeting the requirements for passing the Course, the User may obtain the method of confirming its completion indicated in the Course description:
- certificate of completion of the Course in the form of an electronic document (PDF);
- micro-credential; or
- confirmation of ECTS credits.
- Decisions regarding the completion of the Course, the awarding of ECTS credits, the issuance of a certificate of completion of the Course or the Micro-Credential are made exclusively by authorized persons or bodies of the partner University providing the Course. These decisions are not made by the AI System or as a result of automated data processing by the AI System.
- The awarding of ECTS credits, the issuance of a certificate of completion of the Course or the Micro-Credentation is subject to the internal regulations and regulations in force at the partner University providing the Course. The recognition of Micro-credentials by third parties depends on the internal rules established by these entities. The Operator does not guarantee the recognition of Micro-credentials.
VIII. Intellectual Property
- The content made available in MyAI University, in particular the teaching materials of the Courses (including texts, presentations, video and audio materials, graphics, assignments and tests), as well as the MyAI University Platform and MyAI University Metaverse software, the graphic elements of the virtual campus and the MyAI University markings, are subject to legal protection, in particular on the basis of the provisions on copyright and related rights, and are the property of the Operator, partner universities, authors of materials or licensors.
- The User is entitled to a non-exclusive, non-transferable and royalty-free license to use the content made available on MyAI University solely for their own educational use, for the duration of the User’s Account, without the right to grant sublicenses.
- Subject to point 2 above, it is prohibited in relation to the content made available in MyAI University in particular: reproduction, recording, distribution, transfer to third parties or public sharing, making audio or video recordings, taking screenshots, automatic downloading, indexing and exploring content, including with the use of robots, scripts and scraping mechanisms, interfering with the content, modifying it or creating studies, as well as using the content to train artificial intelligence models
- The provisions of point VIII.3 do not apply to content for which it is clearly indicated that it is made available under an open license. The use of such content is permissible within the limits of a given license and subject to the obligations arising therefrom, in particular the obligation to indicate authorship and indicate the license.
IX. Personal data protection
- The Operator is the administrator of the Users’ personal data processed in connection with the use of MyAI University.
- Detailed rules for the processing of Users’ personal data by the Operator are specified in the Privacy Policy available at: myaiuniversity.eu/privacy-policy.
X. Reporting violations
- Anyone may report to the Operator content or behaviour that violates the Terms and Conditions or the law, in particular illegal content posted on MyAI University or on MyAI University Discord, as well as violation of the rules of conduct towards other Users.
- The application is made by sending written correspondence to…………………… or to the e-mail address ……………………..
- The report should include: the whistleblower’s contact details, an indication of the content or behaviour to which the report relates, along with information enabling them to be located, and the justification for the report. The report can be made anonymously
- The Operator shall consider the report immediately, in a reliable, objective manner and with due diligence, and shall inform the reporting party of the decision made. In the case of an anonymous report, the Operator shall not provide information on the manner of its consideration.
XI. Complaints about the functioning of MyAI University
- The User may file a complaint regarding the functioning of MyAI University by sending written correspondence to…………………… or to the e-mail address …………………….
- The complaint should include: the name and surname of the User, the address for correspondence or the e-mail address under which the User is registered, a description of the irregularity and the date of its occurrence.
- The Operator may ask the User to supplement the information to the extent necessary to consider the complaint.
- The Operator shall consider reports on an ongoing basis, providing information on the manner of their processing within a reasonable period of time not exceeding 14 days.
- The User may file an appeal against the decision referred to in point 4 to the Operator within 14 days of its receipt. The Operator shall consider the appeal within 14 days. The decision made as a result of considering the appeal is final within the proceedings conducted by the Operator.
- Complaints regarding the substantive content of the Course, the evaluation of the credit work, the completion of the Course, the awarding of ECTS credits, the issuance of a certificate of completion of the Course or the Micro-Certificate shall be considered by the partner University making the Course available, in accordance with the rules applicable therein. The Operator shall immediately forward such a notification to the relevant partner University and inform the User thereof.
- Complaints regarding External Tools are handled by their providers, on the terms and conditions specified in their terms of use. The Operator informs the User thereof, indicating, if possible, the appropriate mode of notification.
- Filing a complaint does not limit the User’s rights under the law or the possibility of pursuing claims in court.
XII. Out-of-court Dispute Resolution Methods with Consumers
- The provisions of Section XII shall apply to the User who is a consumer within the meaning of Article 22¹ of the Civil Code, to the extent that the dispute with the Operator is subject to the provisions on out-of-court settlement of consumer disputes.
- The use of out-of-court methods of handling complaints and pursuing claims is voluntary. The following provisions are for informational purposes only and do not constitute an obligation of the Operator to use out-of-court methods of dispute resolution.
- In the event that the dispute has not been resolved as a result of a complaint filed by the User who is a Consumer, referred to in Section XI, the Operator shall each time provide the User with a statement of intention to submit a request to initiate proceedings for out-of-court settlement of consumer disputes, consent to participate in such proceedings or refusal to participate in proceedings for out-of-court settlement of consumer disputes. Lack of a statement means consent to participate in proceedings for out-of-court settlement of consumer disputes.
- The rules for conducting proceedings on out-of-court settlement of consumer disputes and the obligations of entrepreneurs in this regard are specified in the Act of 23 September 2016 on out-of-court settlement of consumer disputes (Journal of Laws of 2016, item 1823). The register of entities authorised to conduct such proceedings is kept by the President of the Office of Competition and Consumer Protection; the register and information on the rules of access to procedures are available on the website of the Office of Competition and Consumer Protection at https://polubowne.uokik.gov.pl/rejestr,5,pl.html
- In particular, a user who is a consumer may apply to the voivodeship inspector of the Trade Inspection Authority with a request to initiate proceedings for out-of-court settlement of the dispute, pursuant to Article 36 of the Act of 15 December 2000 on the Trade Inspection Authority, or to a permanent arbitration court attached to the voivodeship inspector of the Trade Inspection, pursuant to Article 37 of this Act. The user may also obtain free assistance from the district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection.
- Detailed information on the possibility for the Consumer to use out-of-court methods of handling complaints and pursuing claims and the rules of access to these procedures are available at the headquarters and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Voivodeship Trade Inspection Inspectorates and, for example, at the following web addresses:

- A user who is a consumer residing in a Member State of the European Union other than the Republic of Poland can obtain information and assistance in a cross-border dispute in the European Consumer Centres Network (ECC-Net) through the European Consumer Centre competent for their country.
- The provisions of this paragraph do not exclude the User’s right to pursue claims in court.

XIII. Changes to the Terms and Conditions
- The Operator may amend the Terms and Conditions for important reasons, in particular in the case of:
- changes in the provisions of law governing the provision of electronic services affecting mutual rights and obligations arising from the Terms and Conditions,
- the need to adapt the Operator’s activities to the decisions, recommendations, guidelines or rulings of the competent authority or court, affecting the rights or obligations of the parties resulting from the Terms and Conditions,
- changes in the manner of providing services caused by objective technical or technological reasons, in particular the need to update the technical requirements specified in the Terms and Conditions,
- changes in the scope or rules of providing services covered by the Terms and Conditions, in particular the provision of new functionalities, modifications or withdrawals of existing ones, as well as changes in the scope of use of AI Systems,
- changes in the conditions for the implementation of the EUonAIR project, including the composition of the consortium or the rules of financing, affecting the scope of services provided,
- change in the scope of cooperation with providers of technical solutions or suppliers of External Tools, affecting the manner of providing services,
- adapt the provisions of the Terms and Conditions to the services actually provided,
- change of the Operator’s identification data indicated in the Terms and Conditions.
- The Operator informs Users about the change in the Terms and Conditions by sending information about the planned change to the User’s e-mail address at least 14 days before the change is introduced.
- A User who does not accept the amendment to the Terms and Conditions may terminate the agreement for the provision of services by electronic means with immediate effect before the date of its entry into force, by sending a statement to the Operator’s address or deleting the Account. Failure to terminate the agreement before the date of entry into force of the change means its acceptance.
- Making available a new functionality that does not involve a change in the User’s rights or obligations, changing the Operator’s contact details, addresses for applications and removing obvious clerical errors do not constitute a change to the Terms and Conditions and do not require compliance with the procedure specified in paragraphs 2-4. The Operator shall immediately inform MyAI University of such a change.
- The amendment to the Terms and Conditions shall be effective after 14 days from the date of its publication.
- The use of services before the date of entry into force of the change shall be subject to the Terms and Conditions in their current wording.
XIV. Final provisions
- In matters not regulated by the Terms and Conditions, the provisions of the law applicable to the Operator, i.e. Polish law, shall apply.
